Terms of Service

1. Acceptance of Terms
By accessing or using DefendWise ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Service Description
DefendWise provides AI-native security awareness training, phishing simulation, and compliance reporting tools designed for Managed Service Providers (MSPs). The Platform includes white-label branding, automated training delivery, and subclient management.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity under your account, including activity by subclient organisations you create.
- You must provide accurate information during registration and keep it up to date.
4. Pricing and Payment
DefendWise is offered at a flat monthly fee as displayed on our pricing page. This includes unlimited learners and unlimited subclients. Pricing is subject to change with 30 days notice. All fees are non-refundable unless otherwise stated.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Attempt to reverse engineer, decompile, or disassemble any part of the Platform.
- Resell access to the Platform outside of the intended MSP subclient model.
- Use phishing simulation features against individuals without proper authorisation from their organisation.
6. Intellectual Property
All content, training materials, and AI-generated assets provided through the Platform remain the intellectual property of DefendWise. Your branding assets (logos, colors) remain your property. You are granted a non-exclusive license to use DefendWise content for the purpose of delivering security awareness training to your clients.
7. Limitation of Liability
To the maximum extent permitted by law, DefendWise shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
8. Termination
Either party may terminate this agreement with 30 days written notice. Upon termination, your access to the Platform will be revoked and your data will be retained for 90 days before deletion, unless otherwise requested.
9. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria.
